Road Traffic Accidents
CAR ACCIDENTS
1.We were instructed by our client following his involvement in a serious road traffic accident.
At the time of the accident he was driving his works lorry when a third party vehicle came around a corner too fast, lost control of the vehicle and went underneath the lorry that our client was driving.
Tragically the driver of the vehicle died at the scene of the accident.
Our client suffered both psychological and physical trauma. He suffered whiplash type injuries requiring extensive treatment and flashbacks and nightmares. He was unable to resume employment and was medically retired. Initial proposals put forward by the insurance company were not acceptable and therefore Court proceedings were issued. The matter did eventually settle for a sum in excess of £150,000.00.
2. Our client instructed us to assist him following a road traffic accident. Our client's vehicle was stationary hen he was hit from behind by the Defendant's car.
Our client sustained significant neck injuries in the accident together with psychological injuries. He was unable to return to his pre accident employment. Court proceedings were issued and this matter settled shortly before trial for the sum of £180,000.00.
3. We assisted our client in successfully recovering damages for personal injuries and other losses following a road traffic accident. He was a passenger in a car. The driver of the car fell asleep thus causing the car to hit the central reservation on the motorway. Our client sustained significant physical injuries which prevented him from returning to his pre accident employment. A number of defendants were involved in this complex claim and court proceedings had to be issued. This matter settled approximately a week before trial for £200,000.00.
MOTORCYCLE ACCIDENTS
1. We acted for a client who suffered serious leg and hand injuries following a motorcycle accident. The circumstances of the accident are that the client was filtering through traffic when a third party vehicle pulled out of that stationary queue into our client's path resulting in the collision.
Due to the serious nature of the injuries our client underwent a prolonged rehabilitation programme to help him recover from his injuries, much of which was paid for by the defendant's insurers.
The claim settled for £70,000.
2. We assisted our client to successfully pursue a claim for damages for personal injuries and other losses following his involvement in a serious motorcycle accident. At the time of the accident he was travelling on a dual carriage way when a third party vehicle that was waiting to join the dual carriage way suddenly pulled out in front of our client causing a collision. Our client suffered very serious leg fractures and had to be airlifted to hospital. he claim settled for in excess of £42,000.
BICYCLE ACCIDENTS
We were instructed by a young woman following a bicycle accident that took place in Brighton. At the time of the accident she was cycling in a cycle lane and as she passed a junction a car pulled out failing to give way to her and collided with our client, knocking her off her bicycle.
As a result of the accident the client suffered soft tissue injuries as well as psychological trauma. In this case Court proceedings were issued as the offers put forward by the insurance company were not acceptable. The claim eventually settled for the sum of £10,000.
PEDESTRIANS
We assisted a young man to successfully bring a claim for damages for personal injuries and other losses following a serious road traffic accident.
At the time our client was a pedestrian. He was dragged along the road by the Defendant's car and as a result suffered serious head injuries. The claim was initially denied both with regards to responsibility for the accident and as to the value of the claim.
Court proceedings were issued but the matter settled close to trial for a sum in excess of £170,000.00.
MIB/UNINSURED DRIVER
We were instructed by a young man following serious injuries he received whilst a passenger in a vehicle. Unfortunately the driver of the vehicle in which he was a passenger did not have insurance and therefore the matter was pursued through the Motor Insurers' Bureau. As a result of the accident our client suffered injuries to his cheek bone, right eye socket, front teeth and a fracture to his right arm. He also suffered psychological trauma including flashbacks, nightmares and a change in personality.
Court proceedings were issued against the MIB. The claim settled for over £18,000.
Accidents at Work
1.We were instructed by our client to pursue a claim for damages for personal injuries and other losses following a serious accident at work. Our client was working on the roof of a factory when he fell through an unmarked skylight. As a result of the fall he sustained significant physical and psychological injuries.
This was a complicated case and it was necessary to issue court proceedings. Due to the severity of our client's injuries he was unable to return to his pre accident employment.
This matter settled at a meeting with the Defendant's insurers and legal representatives for over £500,000.00.
2. We acted for our client following an accident at work.
Our client was working on the roof of a building. The scaffolding that had been erected was defective and our client fell two floors below. As a result of the fall he sustained significant neck injuries.
It was necessary to issue court proceedings. The matter settled by negotiation for in excess of £60,000.00.
3. We assisted a young man following an accident at work.
The accident was complicated in that there was more than one Defendant responsible. Our client was working on scaffolding in a lift shaft but one of the scaffolding boards was loose causing our client to fall through the scaffolding boards and suffer an injury to his neck and left shoulder. Fortunately for the client he only fell one floor whereas at the time of the accident he was seven floors up.
Liability was disputed by both defendants.
In addition to suffering physical injuries the client also suffered psychologically as following the incident he had a fear of heights and work to do with lift engineering.
Court proceedings were issued against both defendants but the matter settled prior to trial for just over £20,000.00.
Lifting Accident
1.We were instructed by our client to pursue a claim for damages for personal injuries and other losses following a lifting accident at work. Our client had not received sufficient and adequate training and as a result of the lifting accident he sustained an injury to his shoulder.
As liability was denied court proceedings were issued. This matter eventually settled shortly before trial for £20,000.00.
2. We assisted a gentleman in bringing a claim following a back injury at work.
The client suffered a back injury after lifting a parcel. The claim was pursed under the Manual Handling Regulations. Liability was denied and court proceedings were issued.
The claim settled prior to trial for £50,000.00.
Industrial Disease
We acted for our client in connection with a claim against his former employers following exposure to asbestos. The exposure occurred over forty years previously whilst our client was working in a shipyard. It was not until he was much older that he started experiencing symptoms related to asbestos exposure. He eventually contracted mesothelioma (a terminal lung disease associated with asbestos exposure) and sadly died. The claim was continued on behalf of our client's widow and settled for a sum in excess of £100,000.00
Accidents in Public Places
1. We assisted our client in recovering damages for personal injuries and other losses following a tripping incident. The brief circumstances of the accident are that she tripped over a defective pavement suffering an injury to the cruciate ligament of the left knee.
Liability was admitted.
Our client had to undergo two operations on her left knee.
Court proceedings were issued against the Council as we were not happy with the figure proposed for the injury.
The claim settled for £22,500.00.
2. We acted for a man in connection with a claim for damages for personal injuries and other losses following an accident in a public park. Whilst walking his dog he sustained an injury to his foot after putting it in an unmarked hole.
Liability was admitted by the council's insurers and the claim settled for £5,000.00.
Supermarket Accident
We were instructed by an elderly man to pursue a claim following an injury he suffered after he slipped on a supermarket floor. The cause of the slip was that there was spilt sugar on the floor making the floor slippery.
The client suffered a hamstring injury and also it affected his confidence.
Liability was admitted.
Fortunately for the client made a very quick recovery from his injuries. The claim settled for £1500.00.
Fatal Accidents
We were instructed by a young woman and her family to pursue a claim following the tragic death of her husband in a head on collision. We dealt with the inquest on behalf of our client.
The matter was complex as there was not only a claim on behalf of the widow but her children.
The matter settled for in excess of £300,000.00.
Children
We were instructed on behalf of a child following an accident at school.
The circumstances of this claim are that whilst using gym equipment at school she fell and landed on the wooden flooring. The claim was brought against the school on the basis that the crash mats provided were not adequate.
Liability was denied and Court proceedings were issued.
Our client suffered fractures to both ankles and also psychological trauma as a result of the accident.
The matter settled before trial and the settlement was approved by the Court for the sum of £17,000.00.
Assault
We assisted a teacher to pursue a claim for injury following an assault when she was assaulted by a pupil at school.
The physical injuries she suffered were very minor but psychologically she was traumatised by the incident and found it hard to return to school as a teacher.
The matter was pursued through the Criminal Injuries Compensation Authority who awarded our client the sum of £1,000.00.
