Funding
Legal aid is still available for victims of child abuse. This is known as public funding. It can be difficult to obtain public funding because of the stringent rules and guidance of the Legal Services Commission, but it is not impossible and if you are on benefits or in prison then, financially, you will be eligible and we will need to submit an application. This application can take quite some considerable time to be assessed by the Commission. If, however, you get legal aid then your legal costs will be met by the Legal Services Commission, subject to any contribution that you make. If you lose, then you only lose your contributions but if you win then you should recover your costs from the Defendants, whoever that may be. However, sometimes there is a shortfall which is known as the statutory charge. WBW rarely deduct money from our clients damages.
Other funding options are as a private paying client which would mean you would fund the case and should you lose you will be liable for the costs of the Defendants but should you win the Defendants, whoever they are, would be liable for your costs and whatever costs you paid out would be refunded.
In addition there is the option of a No Win, No Fee Agreement which we can sometimes consider, depending on the circumstances.
